STATUTE ON SCIENTIFIC-ADVISORY COUNCIL UNDER THE CONSTITUTIONAL COURT OF THE REPUBLIC OF UZBEKISTAN
(approved by the decision of the Constitutional Court of the Republic of Uzbekistan No.4 from January 30, 2004)
  1. The Scientific-Advisory Council under the Constitutional Court of the Republic of Uzbekistan (hereinafter the Scientific-Advisory Council) shall be an advisory organ exercising its work on a pro-bono basis.

The activity of the Scientific-Advisory Council shall be directed to the preparation of proposals on provision of supremacy of the Constitution.

The Scientific-Advisory Council shall serve to provide assistance to the Constitutional Court on the matters of legal science and practice of the constitutional control as well as on utilizing the achievements of the foreign legislation more comprehensively.

  1. To the membership of the Scientific-Advisory Council shall be elected the qualified specialists in the field of politics and law. The specialists of the other branches of science and practice who are not the member of the Council may be engaged to its activity.

 

  1. The Scientific-Advisory Council shall be elected on the proposition of the Chairman of the Constitutional Court of the Republic of Uzbekistan consisting of the Chairman, Deputy Chairman, Academic Secretary and the members of the Council.

 

  1. The Scientific-Advisory Council shall be elected for the term of office of the Constitutional Court of the Republic of Uzbekistan.

 

  1. The matters for the consideration of the Scientific-Advisory Council on its sessions shall be introduced by the Chairman of the Constitutional Court of the Republic of Uzbekistan.

 

  1. The Scientific-Advisory Council shall:

– give scientifically valid recommendations on the matters introduced for the consideration of the Constitutional Court of the Republic of Uzbekistan;

– elaborate the proposals on improving the legislation related to the exercising of constitutional control;

 

  1. The sessions of the Constitutional Court shall be held as necessary in the environment of constructive discussion and free expression of opinion. The member of the Council inconsistent with the made decision shall be entitled to present dissenting opinion which shall be brought to the notice of the management of the Constitutional Court.

 

  1. The Chairman of the Scientific-Advisory Council shall organize the work of the Council, convene the sessions, charge the members of the Council on preparing the recommendations, and exercise the control on their accomplishment.

 

  1. The Academic Secretary of the Scientific-Advisory Council shall organizationally secure the work of the Council, prepare the materials for the sessions, take minutes, and maintain office administration.

 

  1. Securing the activity of the Scientific-Advisory Council with organizational-technical facilities shall be vested on the Administration of the Constitutional Court. 

 

  1. The Scientific-Advisory Council shall annually present to the Chairman of the Constitutional Court the report about its activity.
