1. General Provisions

1. A Scientific Advisory Council shall be established under the Constitutional Court of the Republic of Uzbekistan as an advisory body operating on a voluntary public basis.

2. The Scientific Advisory Council under the Constitutional Court of the Republic of Uzbekistan (hereinafter referred to as the Scientific Advisory Council) shall carry out its activities in accordance with the Constitution of the Republic of Uzbekistan, the Constitutional Law “On the Constitutional Court of the Republic of Uzbekistan”, the Rules of Procedure of the Constitutional Court of the Republic of Uzbekistan, and this Regulation.

2. Tasks and Functions of the Scientific Advisory Council

3. The task of the Scientific Advisory Council is to assist the Constitutional Court in matters of legal science and constitutional review practice, as well as in making the fullest possible use of the legislative acts of developed foreign countries.

4. The Scientific Advisory Council shall perform the following functions:

develop scientifically substantiated recommendations on matters relating to the activities of the Constitutional Court;

provide scientifically substantiated recommendations on matters submitted for consideration at meetings of the Constitutional Court;

develop proposals for improving legislative acts aimed at implementing constitutional review;

submit proposals concerning the information presented annually by the Constitutional Court to the Chambers of the Oliy Majlis of the Republic of Uzbekistan and the President of the Republic of Uzbekistan on the state of constitutional legality in the country, based on the results of generalizing the practice of constitutional proceedings.

3. Composition of the Scientific Advisory Council and Procedure for Its Formation

5. The Scientific Advisory Council shall consist of highly qualified national and foreign specialists in the fields of politics and law. Specialists from other branches of science and practice who are not members of the Scientific Advisory Council may also be involved in its work.

6. The Scientific Advisory Council shall be elected at a meeting of the Constitutional Court, upon the recommendation of the Chairperson of the Constitutional Court, and shall consist of the Chairperson of the Council, the Deputy Chairperson, the Secretary, and members of the Council.

7. By virtue of their respective positions, the Deputy Chairperson of the Constitutional Court shall serve as the Chairperson of the Scientific Advisory Council, while the Head of the Expert Group of the Constitutional Court shall serve as the Secretary of the Scientific Advisory Council.

8. The composition of the Scientific Advisory Council may be reviewed every three years or as necessary.

4. Organization of the Activities of the Scientific Advisory Council

9. Matters to be considered at meetings of the Scientific Advisory Council shall be submitted by the Chairperson of the Constitutional Court or their Deputy.

10. Meetings of the Scientific Advisory Council shall be held in an atmosphere of academic discussion and free expression of opinions.

11. Decisions of the Scientific Advisory Council shall be recommendatory in nature.

12. The Chairperson of the Scientific Advisory Council shall organize its work, convene meetings, and assign tasks to Council members regarding the preparation of the Council's recommendations.

13. The Secretary of the Scientific Advisory Council shall provide organizational support for the Council's activities, prepare materials for meetings, maintain meeting minutes, and handle administrative records.

14. Meetings of the Scientific Advisory Council may be held via videoconferencing.

5. Rights and Obligations of Members of the Scientific Advisory Council

15. A member of the Scientific Advisory Council shall have the right to express their opinion on matters under consideration at a meeting of the Constitutional Court.

16. A member of the Scientific Advisory Council shall have the right to participate in Council meetings and submit scientific and theoretical recommendations and proposals on agenda items.

17. A member of the Scientific Advisory Council who disagrees with an adopted decision shall have the right to submit a dissenting opinion, which shall be brought to the attention of the leadership of the Constitutional Court.

18. A member of the Scientific Advisory Council shall be obliged not to disclose official information or materials relating to cases under consideration by the Court.

6. Final Provisions

19. Organizational and technical support for the activities of the Scientific Advisory Council shall be provided by the Secretariat of the Constitutional Court.

20. The Scientific Advisory Council shall report on its activities annually at a meeting of the Constitutional Court.
